Former Guam delegate Michael San Nicolas has pleaded not guilty to driving while impaired and reckless driving charges stemming from a July incident in Tumon.

San Nicolas appeared virtually for his arraignment before Magistrate Judge Jonathan Quan, who confirmed he had been allowed to leave Guam. His attorney, Michael Phillips, entered the not-guilty plea on his behalf, and the case has now been assigned to Judge Maria Cenzon.

Court documents state San Nicolas—who served two terms as Guam’s delegate to Congress—was arrested after overturning his vehicle following a night of drinking. Police officers responding to the crash say he appeared intoxicated, smelled of alcohol, and failed a field sobriety test.

San Nicolas faces misdemeanor and petty misdemeanor charges.
