Inafa’maolek Food Donation Act supports Public Health’s push for modernized food code

The Department of Public Health and Social Services, Division of Environmental Health acknowledges the enactment of Public Law 38-24, also known as the Inafa’maolek Food Donation Act.
This new law encourages the donation of safe, wholesome food to those in need while protecting donors from liability when food is donated in good faith.
The law allows DPHSS to promote the food recovery of food fit for human consumption through outreach, online educational campaigns, newsletters, bulletins, and handouts that inform retail food facility operators about the protections from civil and criminal liability when donating food.
The timing of this law aligns with DEH’s ongoing effort to update the Guam Food Code, which is currently based on the 2005 Model Food Code.
In collaboration with the Guam Food Safety Advisory Group, DEH is working to adopt the 2022 Model Food Code, the most current federal standard, which explicitly acknowledges and authorizes food donation.
“This isn’t just about food, it’s about dignity, compassion, and taking care of one another,” said DPHSS Director, Theresa C. Arriola. “The Inafa’maolek Food Donation Act reminds us that even what we consider extra can be everything to a family in need. It reflects the care and connection that continues to shape how we support each other and it’s a step forward in keeping Guam’s food safety standards strong.”
As efforts to adopt the 2022 Model Food Code continue, DPHSS remains committed to informing the public and supporting efforts that reflect both best practices and the island’s shared values.
