A man convicted of sexually assaulting a 10-year-old girl is finally in custody, nearly four years after he failed to report to prison. Richard Silvester Kette pleaded guilty in 2021 to 2nd -degree criminal sexual conduct and was sentenced to seven years behind bars.

But instead of self-surrendering, he remained free - until Friday’s warrant return hearing.

In court, Superior Court Judge Vernon Perez told him, “I’m just glad you’re now in custody, and you’re in custody for some years.” Prosecutor Christine Tenorio requested Kette be immediately remanded. His attorney didn’t object but asked for time to meet with his client. The judge agreed, but made it clear Kette will stay locked up at the Department of Corrections.

Kette was charged after a girl reported years of abuse starting at age 6. Court documents say the assaults happened several times a week when Kette was drunk.

His next hearing is set for August 4.
