Attorney provides updates on lawsuit against Guam Department of Education to lawmakers

An update on the lawsuit against the Guam Department of Education, which is accused of violating the Adequate Education Act.
Attorney Daniel Sommerfleck of the Guam Legal Services Corporation Disability Law Center said the court has declined to issue an injunction, noting that schools have passed sanitary inspections at this point.
However, the court did find that Ocean View Middle School did not provide a safe and sanitary environment for students.
In addition, the court determined that GDOE failed to provide certified teachers.
Somerfleck gave the latest on the case during an informational briefing with lawmakers earlier this week.
“The court also wants us to come back in July–end of July for trial on the issue of mold in the schools because that is not inspected by Public Health. We got over a number of hurdles, and we still have one to go,” said Somerfleck.
Meanwhile, as KUAM previously reported, separate legal action is underway alleging that GDOE violated the Americans with Disabilities Act at Southern High School.
The case is being heard by a judge in Saipan after Judge Frances Gatewood declared a conflict of interest, as her brother is employed by the corporation.
