The Office of Public Accountability is now reviewing an appeal filed by ASC Trust LLC, challenging a procurement by the Government of Guam retirement fund. 

The case centers on a contract for plan administration services tied to the island’s Defined Contribution Retirement System and Deferred Compensation Plan.

ASC argues the procurement process violated Guam law by not applying a local preference policy, which supports awarding contracts to businesses based in Guam that meet specific criteria.

Although the retirement fund removed a disputed transition planning requirement from its request for proposals, it denied ASC’s protest over the local preference issue.

ASC now wants the OPA to find the RFP inconsistent with local law and is requesting that the procurement either be reformed or re-solicited to reflect Guam’s preference for local businesses
