How does a repeat offender accused of rape get out of jail, while his co-defendant remains locked up?

It's a question Superior Court presiding Judge Alberto Lamorena asked parties in the case today. 

As KUAM reported, co-defendants Timo-ju Palik and Gabereile Ferreira face first-degree criminal sexual conduct charges.  

The pair allegedly raped a 14-year-old boy while they were clients at the Department Of Youth Affairs between April and October 2023. 

Prosecutor Jacob Wagner admitted Palik’s release did not make sense.

Defense Attorney Tyler Scott responded stating, “I am very persuasive.”

The issue surfaced after probation told the court Palik had not reported to his probation officer.

Lamorena issued a warrant for his arrest stating, “I wouldn't be surprised if he fled the island.”

Meantime, Ferreira’s request to be released from prison will be argued at a later date.

Parties are scheduled back in court on Nov. 19.
