Ten years for brutally beating an elderly man

A man gets 10 years in prison after being accused of brutally beating an 82-year-old man known to him.

Daniel Depamaylo, who was charged with aggravated assault and family violence, took a no contest plea.

He contends he never attacked the victim. 

But, prosecutors read a letter from Depamaylo's accuser asking the court to give him the maximum sentence.

Presiding Judge Alberto Lamorena questioned why prosecutors didn't charge him with aggravated murder. 

Depamaylo got 10 years in the Department of Corrections prison with credit for the two years he already served.
