Attorney General of Guam Doug Moylan’s request for a rehearing in the withdrawal case has been denied by the Supreme Court of Guam.
This comes after the high court issued a judgment ruled in Governor Lou Leon Guerrero’s favor in the AG’s conflict case.
As you may recall, his office temporarily withdrew legal services from some 22 government of Guam agencies his office is investigating based on OPA reports.
Justices held that the Attorney General has an attorney-client relationship with executive agencies and the rules of professional conduct apply.
Moylan has since petitioned for a rehearing in the matter arguing communication with executive agencies is not confidential when he has a duty to report evidence of impropriety.
The Supreme Court ruled today that a rehearing is not warranted.
Justices said the court did not overlook or misapprehend any provision of Guam law relating to communications between agencies and their attorneys, any material points of law on conflicts of interest, or any material points of law about the Governor’s authority.
“The Attorney General’s arguments seek to undermine this basic conclusion of law, upending even the most basic requirements of the Guam Rules of Professional Conduct. Like all attorneys and their clients, the Attorney General owes a duty of confidentiality and loyalty to the agencies he represents,” their order read.
