The defendants accused in the killing of an Army veteran are set to have their day in court this week but two of them were released from prison after prosecutors called for the charges to be dismissed. 

Prison records show Brandon Chandler and Jason Manibusan were released from the Department of Corrections. 

This after a Superior Court judge granted the prosecution's request for a dismissal without prejudice. 

Co-defendants Cynthia Quinata, Jordan Babauta and Gregory Reese remain on the hook for their alleged roles in the murder of Jason Susuico. 

Jury selection and trial is set to begin tomorrow before Judge Arthur Barcinas.
