A man convicted of raping a woman in her Hagat home wants a new trial in the Superior Court of Guam.

Paris Sharpe is serving 10 years after being convicted of 3rd-degree criminal sexual conduct.

His defense contends that his Sixth Amendment rights were violated when he was not allowed to question Guam Legal Services Corporation employees about the date the victim told them the sexual abuse occurred.

Sharpe was already denied that argument resulting in his case being taken to the high court.

Attorneys arguing his appeal before justices in the Supreme Court of Guam today.

"An adult complainant, you would think would have got her story straight right from the beginning if this had actually happened. In his reason to have the trial court interview the civil attorney and find out what she did or did not say that may be relevant to the guilt or innocence of the defendant," said defense attorney Bill Bischoff.

"They chose to believe her and find that the inconsistencies did not matter. And that's because she called the police numerous times for this one individual," said prosecuting attorney Christine Tenorio. "The testimony came out from so many different police officers and that's why she was confusing the dates, but she was always consistent with the body position of the sexual assault...they were able to present a complete defense."

As reported, the victim told police she was walking out of her bathroom when Sharpe grabbed her from behind and raped her.

Justices took the matter under advisement.
