District Court of Guam Chief Judge Frances Tydingco-Gatewood issued an order detailing the status of post closure efforts at the Ordot Dump.

Her order noted receiver Gershman, Brickner & Bratton needs more information from the Guam Waterworks Authority to better understand and evaluate the impact of waterline leaks around the vicinity of the dump.

The court ordered parties to resolve the issue and any potential claim Guam Solid Waste Authority may have for overpayment of leachate

The chief judge also noted a report by Brown and Caldwell on the leachate flow evaluation and cessation of discharges to waters of the United States. GBB told the court they will need time to review and discuss the findings.

Additionally, the recently created Ordot Dump Reserve Fund that became law during the current legislature was listed in the order noting the government of Guam’s net settlement in the CERCLA case is about $30 million.

“In order to safeguard these funds for the post-closure care of the Ordot Dump, GSWA proposes to deposit the monies into a trust fund with a RCRA-compliant Trust Agreement,” the order states. “The court concurs with this proposal and directs the parties to make it a priority to finalize the trust agreement with the Bank of Guam so that the funds can be moved and begin earning interest.”

Another status hearing is scheduled for Sept. 11.
