The Attorney General and Adelup remain at odds over the AG's withdrawal of legal representation from more than 20 agencies that are under investigation based on OPA audits.

The Governor has asked the Supreme Court to weigh in on whether private counsel can be hired to review big-ticket contracts in lieu of the AG.

Adelup released its brief, and a key argument is that “the AG is in effect holding agency legal services hostage unless they agree to waive important rights.”

Moylan said he will continue reviewing their contracts, but with the caveat that he does not directly represent them and thus cannot be disqualified from prosecuting alleged corruption.

But Adelup argued that  “Moylan’s Organic Act role to represent government agencies is not subject to his unilateral, inconsistent and self-serving qualifications of that duty.”

The AG has submitted a separate brief.

There is no word yet on “if and when” the Supreme Court might hear oral arguments.
