A man accused of molesting a young girl is denied his request for a mistrial.

Defendant Danny Rodriguez has been on trial in the Superior Court on charges of first and second-degree criminal sexual conduct.

Defense sought a mistrial arguing his due process rights were violated and prosecutorial misconduct.

Superior Court Judge John Terlaje rejected the request, noting the court will instruct the jury not to construe his silence during interrogation as him being guilty of the crime.

As KUAM reported, the victim alleged he first started to sexually abuse her when she was 6-years-old.

The alleged abuse continued in 2020 when she was 11.
