A man serving 40 years in prison in connection to an Ordot home invasion could be getting time off his sentence after partially winning his fight in the Supreme Court of Guam.
Francis Jerome Taisacan argued that prosecutors lacked evidence to support the home invasion conviction, three jury instructions were erroneous, and several of the convictions were redundant.
Justices agreed and reversed the home invasion conviction stating Taisacan was armed with an airsoft pistol, adding it was never proven at trial it was a deadly weapon.
The conspiracy to commit home invasion, second-degree robbery, and special allegation of vulnerable victim convictions stand.
The high court remanded the case back to the Superior Court for re-sentencing.
