The lawsuit against Guam Department of Education Superintendent Dr. Kenneth Swanson and the members of the Guam Education Board is at a standstill. 

The case involves GDOE parents of two separate minor children with disabilities suing Swanson and the GEB for allegedly failing to provide their children with adequate public education—representing them is attorney Daniel Somerfleck. 

 Somerfleck was previously granted an order to show cause by Superior Court Judge Dana Gutierrez for last Friday's hearing on the matter.

However, Swanson told KUAM Gutierrez recused herself from the case due to her relative being an employee of GDOE.

 “Rightfully, the judge recused herself because her sister is one of our principals–a new judge has been appointed, and we don’t have a new court date," he said. 

Kuam has reached out to attorney Somerfleck for comment on the case. We are still awaiting a response.
