Trial began for a man accused of raping a woman in her home.

Robby Narruhn appeared before Judge Vernon Perez today with attorneys making their opening statements. 

Prosecuting attorney Christine Tenorio told the jury that Narruhn will say he wasn’t there, DNA says otherwise.

“His DNA was in her cervix," she said. "At this point, I'm not sure actually what the defense is thinking, right now it'll be consent because his DNA is there…while you're assessing this, of course, in your mind, the question is whether or not that this was consent.”

However, defense attorney Peter Santos says there’s always three sides to every story.

“While there's other activities going on that morning, that day, every day in the house, and that you're going to hear that there's always tons of people in the house," he said. "And that Mr. Narruhn and one of her children were very close friends. And so there may be you might hear or think you will hear the reason not to tell everyone about your relationship.”

Narruhn was charged with burglary and third-degree criminal sexual conduct. On Feb. 15 2022, police officers responded to a residence in Harmon. The victim explained to officers that she was sleeping in her room that afternoon when she suddenly woke up to Narruhn sexually assaulting her. She stated that he was holding a pair of scissors against her lower back as he was assaulting her.
