Grand jury hands down new indictment against health director, chief inspector

Ten additional counts of tampering with public records -- a superseding indictment is handed down by a superior court grand jury against Department of Public Health Director Arthur San Agustin and Public Health Chief Inspector Masatomo Nadeau.
The men have since pleaded not guilty to charges of obstructing governmental functions, official misconduct, and special allegations of crimes against the community.
San Agustin also denied the five counts of tampering with public records at a hearing held about a month ago.
The grand jury now upping the charges against the local health director.
Prosecutors noted a total of 15 counts of public records tampering alleging San Agustin was aware that certain Guam Department of Education schools were given passing health inspection grades for inspections that never occurred.
Initially, court documents listed Simon Sanchez, George Washington, and Southern High Schools as the affected campuses.
Now - the new indictment lists P.C. Lujan, D.L. Perez, Price, Wettengel, J.Q. San Miguel, Juan M. Guerrero, Adacao and Tamuning Elementary Schools, along with Jose Rios, Oceanview, Agueda, and F.B. Leon Guerrero Middle Schools.
The pair will go before Magistrate Judge Jonathan Quan Wednesday morning to answer to the additional counts in the superseding indictment.
During a hearing held today, Judge Elyze Iriarte had to disqualify herself from overseeing both government corruption cases.
There's no word yet which judge will be assigned the cases for trial.
