The man accused in a deadly car crash that claimed the life of a 2-year-old girl was denied his request to get out prison. Defendant Terry Sabnat appeared before Magistrate Judge Benjamin Sison in the Superior Court of Guam today.
Sabnat was driving near family apartment in Upper Tumon back in June when he allegedly hit the child.
Defense attorney Peter Santos asking the court that Sabnat be released under house arrest, noting he's lived on Guam for 20 years and has no prior criminal record.
Santos adding while it was a tragic accident, he argued he does not understand why prosecutors never investigated the victim's parents, calling them irresponsible for letting the toddler go unsupervised.
Prosecuting attorney basil o'mallan saying he takes offense to santos shifting the blame to the child's parents.
Judge sison denied the request for release telling defense to work on getting sabnat on electronic monitoring and to third party custodians before the court reconsiders letting him out.
The 44-year-old has since pleaded not guilty to vehicular homicide, negligent homicide, leaving the scene with injuries, reckless driving, two counts of imprudent driving, and driving without a license.
