A man convicted in multiple armed robberies is appealing his case before the Supreme Court of Guam. Dennis Aldan was sentenced to 20 years in prison in connection to armed robberies reported in 2019 at Papa John's in Mangilao and at Loco Mart in Dededo.

Defense attorney Terence Timblin argued why Aldan is fighting his conviction, while prosecuting attorney Marianne Woloshuck argued against the high court granting his appeal.

"I am asking the court to decide what did it intend when it vacated the second charge but the charge that was left still included all three charges, robbery, robbery, conspiracy," Timblin said. "The court decided that was worth ten years. So it's up to this court."

Woloshuck said, "The defendant here is looking for resentencing based on bundling of charges. We don't think there was any bundling here. But if there was as the chief justice noted, it's by the victim's location. So in the original judgment, you have charge one at Papa John's and that is the robbery with serious bodily injury then you have charge two, the armed robbery, then charge three the conspiracy. Then you have the same thing for Loco Mart location where the victim was. So you have robbery, serious bodily injury, robbery, armed robbery and conspiracy. And there's the amended judgment after remand, which is again by the victim's location."

The justices took the matter under advisement.
