“We build and deliver tiny homes across the Pacific," -- that’s the quote on Guam Pacific Tiny Homes website and social media accounts.

According to the allegations filed against the company's owner in a civil lawsuit and now a criminal indictment, that doesn’t seem to be the case.

The owner, Paul Vincent Untalan Sablan was charged twice with theft of property.

A grand jury handed the indictment that includes 13 total counts against Sablan. He pleaded not guilty before a magistrate judge last week.

Sablan has since been in and out of the courtroom for the past year after the government sued his company for alleged deceptive business practices.

The new criminal case now has Sablan facing even more serious allegations.

Several clients claim they've made down payments but were allegedly not getting the homes built and not getting their money back.

Numerous residents have taken to social media, commenting on the company’s Facebook page, accusing them of scamming an elderly client.

The company responded to the allegation: “The story that was written is very sensational. It certainly gets people emotionally charged... She refused to sign for the changes or make any further payments. We then offered to scale back the project so we could still deliver a tiny house that was within the $20k she already paid. She refused our offer of delivery and said that her plans had changed.”

Above the Tiny Homes online response was a post, dated July 8, 2022, in part stating “the recent news stories about tiny homes have created a lot of interest about the buying process!”

In July 2022, the attorney general's office's Consumer Protection Division filed a civil lawsuit against Sablan. The allegations surfaced after one customer told investigators they paid $20,000, another paid $5,000, and a third customer had his home built but complained of multiple defects.

The AG's office then asked the court to order Sablan to cease illegal business practices, pay back the clients, fix the defects, and pay fines and attorney’s fees.

Additionally, a temporary restraining order has been filed against him.

Investigators also allege that Sablan continues to advertise and offer container homes without a business or contractor's license.

The AG's office says numerous other consumers have since come forward, including one who paid $25,000 for a home that, among other things, did not have a sink or toilet installed in the bathroom. Another consumer who received a defective container home and the two-year warranty to repair it was denied.

As of July 2022, the company’s Facebook posts state that operations are running and interested clients can inquire about working with them.
