The man accused in the deadly shooting of A.J. Mendiola won’t be getting out of prison.

Murder defendant Nathan Ojeda was hoping to be released on house arrest to a third-party custodian.

Chief prosecutor Heather Zona told the court that the victim’s family opposes his release, reminding the judge that Ojeda allegedly admitted to police that he was "happy" Mendiola had died.

Mendiola’s family also attended the virtual hearing standing by to testify.

Superior Court Magistrate Judge Benjamin Sison denied Ojeda’s request stating the alleged crime is extremely violent and the defendant is a flight risk.

The shooting happened back on Jan. 4 in Hagat.

Ojeda tried to take an insanity plea, but doctors ruled he is fit to stand trial.

His day in court is set for Jan. 13, 2024.
