A murder defendant is calling his current four months back in prison "unfair."

But a Superior Court judge felt otherwise.

Nicholas Wayne Moore was again denied his request to get out of jail.

Moore is currently on trial in a drive-by shooting case, and faces separate charges for the murder of Michael Castro along with charges in a rape case.

He posted bail following his initial arrest.

But probation noted Moore has multiple violations including using drugs. This landed him back in prison.

Superior Court Judge Alberto Tolentino denied the request but offered a chance for Moore to find two third-party custodians

 

who can watch him if he is released back into the community
