There is no clear timeframe when the Guam Environmental Protection Agency will decide on the U.S. Air Force's permit to continue burning waste munitions and detonation activity along the northern coast of Guam. Guam EPA spokesperson Nic Lee told KUAM News the application remains under review.

GEPA is working with USEPA Region IX on it.

The response comes after District Court of Guam Chief Judge Frances Tydingco-Gatewood dismissed Prutehi Litekyan: Save Ritidian and EarthJustice's lawsuit against the Air Force, demanding they stop the activity up north.

The group, who tells KUAM News their fight is not over, is concerned over the harmful impacts being caused. The court Wednesday said the issue is for the Guam EPA to tackle.

Lee stated, "At a minimum, final action taken on this permit application will require every practicable course of action to be examined, including an analysis on available alternative technologies on the affected waste streams managed by the base. This is necessary in order for the agency to determine the overall safety hazards and environmental impacts posed by explosives and waste munitions, and the treatment and disposal of such materials."

A spokesperson from Andersen Air Force Base declined comment citing ongoing litigation.
