A federal judge granted a request to dismiss a clergy sex abuse case in the District Court of Guam today.

The case was filed by plaintiff, D.M., who alleged former archbishop Anthony Apuron raped him several times in the mid-1990s.

The request was to toss the case for lack of jurisdiction and insufficient services of processes and failure to state a claim.

After the parties presented their arguments Friday, Chief Judge Frances tydingco-Gatewood granted the request.

She also allowed the plaintiff an opportunity to refile their case.
