A magistrate's complaint has revealed more details into an incident Saturday morning in Tamuning that led to the death of a 23-year-old man.

The victim was identified as Jaron Weilbacher, according to the complaint. He along with two other men were at King's Restaurant in Tamuning when an altercation broke out with another group of men, who fled the scene.

Guam Police Department Sgt. Paul Tapao also spoke on the incident.

"We at Guam Police Department would like to offer our condolences to the family who lost the 23-year-old man," he said.

"Through the course of the detectives working on the case and with the assistance of the Air Force, Office of Special Investigation and Department of Defense police assigned to Andersen Air Force Base. The three men that were identified in the disturbance were located."

Arrested were 31-year-old Fiataugaluia Ahkee, 22-year-old John M. Muliaga, and 36-year-old Joseph Decady.

Muliaga was charged with Aggravated Assault and Assault, while Ahkee was charged with Assault, Decady was booked and released for Criminal Facilitation.

According to court documents, Muliaga allegedly struck Weilbacher and the two other men. Even after Weilbacher fell to the ground Muliaga is accused of striking him several more times. Akhee also allegedly struck Weilbacher who was unconscious.

Tapao said the case remains open as an autopsy has yet to be conducted.

"As you know with previous investigations once a pathologist makes the assessment and the autopsy is performed once we find the cause of manner of death we will adjust accordingly in accordance with the office of the attorney general for additional prosecution and additional charges," Tapao said.

Muliaga and Ahkee appeared before Superior Court Judge Jonathan Quan Monday afternoon. It was revealed that the two are brothers and live together on base.

Probation requested Muliaga's bond be set to $50,000 on the basis that further investigation may bump up his charges, he's only been on island for less than two months, and there are multiple alleged victims involved. Assistant Alternate Public Defender Richard Dirxx, however, argued that $50,000 is out of line for the charge of aggravated assault.

The amount was lowered to $25,000 with conditions upon release.
Ahkee has been serving in the U.S. military for 12 years. He was released on a $2,000 personal recognizance bond with conditions. He moved to Guam from American Samoa in 2019. He is represented by attorney Jay Arriola
Their preliminary hearing is scheduled for Oct. 21 at 4 p.m. before Judge Alberto Lamorena.
