Judge Arthur Barcinas denies Mark Torre, Jr.'s motion for dismissal with prejudice.
An amended indictment charges Torre with aggravated assault and negligent homicide for the 2015 fatal shooting of fellow police officer Elbert Piolo. In the prosecution's second try of the case, Torre argued his right to a speedy trial was violated by the superior court of Guam and the government.
After hearing arguments from both parties, the court orders the case continues in with jury selection and trial scheduled for Thursday, March 5 at 10 a.m. According to court documents, Judge Barcinas says "a decision and order incorporating the court's analysis is forthcoming."
