In the District Court of Guam, Sedfrey Linsangan argues his rights have been violated when he sought to run in the last gubernatorial election.

Linsangan has filed a complaint against the Guam Election Commission for injunctive and declarative relief. This comes after the plaintiff wanted to run for governor but never submitted or followed the necessary procedures of obtaining a running mate or 500 signatures on his petition.

Representing GEC, Attorney Geri Diaz motioned to dismiss with prejudice.

Arguments were heard from both parties, with Chief Judge Frances Tydingco-Gatewood questioning if there is standing for the case. The Chief Judge informs that for injunctive relief a plaintiff must have an imminent injury.

Linsangan ultimately says his complaint is for the court to repeal the law because it's inorganic. After today's hearing Linsangan tells Kuam he feels confident.

"Very confident because emphasized that I have all the standing. I told them I don't even have to declare that I want to run for governor, because it's an automatic standing, when a law or constitution is violated," he said. "I just hope the court will do the right thing and rule in my favor, I am still hopeful."

Chief Judge Frances Tydingco-Gatewood told both parties she will issue an order in a couple days. Linsangan said if the complaint is dismissed then he plans file an appeal with the ninth circuit, he adds that he intends to run in the next election.
