The Office of the Attorney General has filed an appeal to the Supreme Court of Guam's decision and order on the motion to dismiss defendant Gerald Wayne Cruz's indictment.

Cruz is accused of fatally shooting his neighbor in Yigo's cat and dog. He was charged with two counts of animal cruelty as a third degree felony.

In Judge Michael Bordallo's courtroom today, the court scheduled a further proceedings hearing for 30 days from now, in order for the Supreme Court to respond and for Judge Bordallo to see if he has jurisdiction over the case or not. Cruz will return on Nov. 14.
