Guam - A former employee of DAL Global Services or DGS is taking the company to court citing discrimination, harassment, retaliation and wrongful termination.

Jocelyn Orio was fired from DAL Global Services, which is affiliated with Delta Airlines, in May 2012. According to court documents she not only believes she was discriminated against because she is of Filipino descent but also because she suffered from a disability which prevented her from lifting objects over 30 pounds. Orio began working for DGS in April 2011, a part of her responsibilities included cleaning and preparing airliner cabins for flight and loading luggage onto airliners.  However in August of that year her doctor placed her on light duty due to severe knee and back pain. In her complaint filed with the District Court of Guam she outlined instances of alleged discrimination and retaliation, including one that occurred in September 2011 when her shift supervisor allegedly threw a pillow at her face and shouted at her. In referring to the way she cleaned tray tables, he allegedly remarked as to whether that is the way she cleans her private part. There was another instance in which the same supervisor is accused of referring to her as a "mamasan". When Orio wrote a letter to management detailing the allegations of harassment and discrimination she says it was handed back to her and things only got worse. Not only was she allegedly forced to do unusually difficult and distasteful tasks she had never been assigned before she was also forced to change her schedule and reduce hours and pay just to avoid the harassment. Since being terminated Orio says she has been unable to find alternative employment.  She is asking for combined damages of up to $400,000 and attorney fees.
