Defendant wants drug case brought before federal court

Guam - Jay Diaz Santos, the defendant in a year-old drug case is taking it to federal court.
Diaz tried the case twice in Supreme Court but the judge refused to rule on whether or not there was probable cause.
In Santos v. The Superior Court of Guam, the plaintiff is requesting the District Court compel the Superior Court to consider all grounds for the suppression of evidence.
Back in 2013, Diaz was and arrested on drug charges. He alleges officers executed a search warrant for a different address and that the warrant was issued without probable cause.
