Guam - A motion for dismissal and a motion for judgment of acquittal were denied today in the trial of Raymond Tedtaotao. Defense attorney Sam Teker made the motions today as he alleges the prosecution failed to provide the defense with information that their star witness, Kyle Cruz, had lied about statements he made to police.

Tedtaotao is being tried for his alleged involvement in the April Nimitz Hill home invasion case. Teker said the defense was not informed that Cruz had recanted about a written statement he initially gave to police about co-defendant Anthony Mendiola bringing out a gun when Cruz said he didn't want to do the robbery.

Despite the arguments, Superior Court Judge Maria Cenzon denied the motions and determined that the information went more to the credibility of Cruz as a witness rather than to the actual offenses Tedtaotao has been charged with.

The parties are now going over jury instructions and closing arguments are anticipated to begin at 1:30 on Monday afternoon.
