Guam - Following a ruling by Judge Michael Bordallo today, DFS Guam will look toward pursuing merits of its case before the Guam Office of Public Accountability for the duty free concession at the A.B. Won Pat International Airport. In a release from DFS' representative, Civille & Tang, they note that the Superior Court of Guam found that GIAA's and Lotte Duty Free Guam's sanctions motions to be meritless and rules that DFS' lawsuit was neither "frivolous nor unreasonable."

Judge Bordallo rejected GIAA's and Lotte's arguments that DFS and its lawyers should be sanctioned for bringing the lawsuit, finding that this request was devoid of merit. Bordallo further rejected GIAA's and Lotte's efforts to expunge comments the court made in its July 19, 2013 order that were unfavorable to the GIAA. In response to their motions, the court found the GIAA's and Lotte's arguments to be "legally unsupportable, inaccurate, speculative and unpersuasive."
