Guam - Carl Gargarita was in court today for a criminal trial setting hearing.  During today's proceedings he requested that he be released to a third-party custodian. Superior Court Judge Maria Cenzon is taking the matter under advisement.  Gargarita is being held on $1 million cash bail accused of choking 33-year-old Anthony Giraloa to death during a fight over a woman last month. He has pleaded not guilty to charges of aggravated murder. He's scheduled to appear back in court on August 6.
