GUAM - Aside from their motion to dismiss, Lotte Duty Free Guam is also seeking judicial disclosure, requesting for clarification of the familial relationship between the presiding judge and a high ranking DFS Guam employee.
Lotte has filed a motion to dismiss DFS' lawsuit against the company and the Guam International Airport Authority over the award of the specialty retail concessionaire contract. Presiding Judge Alberto Lamorena has been assigned the case but Lotte has raised concerns as they believe he is related to a high ranking DFS employee who was involved in the preparation of DFS' proposal and participated in the RFP presentation.
Lotte also alleges there was a potential unauthorized practice of law by off-island counsel for DFS who is required to apply to practice temporarily on Guam for the case. A hearing is scheduled for July 1st at two o'clock.
