Guam - Superior Court Judge Michael Bordallo has denied a defense motion to depose two prosecutors. Attorney Randy Cunliffe had made the ex-parte request on Monday asking that he be allowed to depose two assistant attorneys general who he believes has pertinent information about the relationship between Asst. AG Richelle Yu and Superior Court Judge James Canto. Cunliffe has filed an objection in his client's, Kyle Evan Blas, criminal case to the judge presiding over the case due to his relationship with Yu.

The defense has questioned the judge's ability to be fair and impartial, something Canto has repeatedly defended. Canto has said he can remain objective and has always treated both sides fairly despite his open and public relationship with Yu. Judge Bordallo today denied Cunliffe's motion to depose the two prosecutors and took the motion to disqualify Canto under advisement.

The defense also asked the judge to take judicial notice of a document filed in a separate felony criminal case where Yu allegedly signed a document that is assigned to Canto's court.
