Federal receiver using Section 30 funds to cover judgment

Federal receiver Gershman Brickner & Bratton is against using section 30 bond funds to pay a multimillion dollar judgment to landowners of Dandan property that is being used for the new Layon landfill.

Guam - Federal receiver Gershman Brickner & Bratton is against using section 30 bond funds to pay a multimillion dollar judgment to landowners of Dandan property that is being used for the new Layon landfill. As we reported the landowners have filed a motion to intervene in the Ordot consent decree case as they want to be paid the judgment awarded to them for condemnation of their land.   

GBB representative David Manning tells KUAM News the intervention issue is a matter for the court to decide. But he doesn't believe any funding is available to pay the judgment as he says 2009 Section 30 bond money is needed for the final closure of the Ordot Dump. Manning says if any funds are available after the closure of the Ordot Dump is complete and all other consent decree requirements are met, only then can the remaining funds may be used to cover

The additional land cost.  The landowners have asked the court to pay out the judgment because if they take over the land it would inhibit the government's ability to comply with the consent decree.
