Judge hears motion in GPD overtime lawsuit

Guam - Superior Court Judge Arthur Barcinas has been asked to determine if Guam Police Department officers are entitled to overtime after they work 40 hours a week. Officers work 43 hours a week before they are entitled to overtime, but a Supreme Court of Guam decision in a similar case filed for a group of Customs and Quarantine officers could have an impact.
That decision determined that Customs officers were entitled to OT after working 40 hours and not 43 as they have been mandated to do. As a result of the decision, Customs officers were paid backwages.
The GPD officers' attorney, Daniel Somerfleck, argues the same should apply to the men and women on the police force. A motions hearing was held this afternoon and the judge has taken the motion for summary judgment under advisement.
