Judge hears arguments in Smart Meter lawsuit

Guam - Is Christopher Allen suffering irreparable injury and will he likely succeed on the merits of his lawsuit against the Guam Power Authority? Those were just a few of the many questions asked today by District Court Magistrate Judge Joaquin Manibusan as the parties argued Allen's motion for a preliminary injunction. Allen opposes the meters arguing it is a violation of his rights and could be hazardous to his health.
Allen admitted he is not suffering any injury now, but feels there is a lingering threat if GPA doesn't agree to bypass his home completely until after the court case is resolved. The judge noted that in order for a preliminary injunction to be granted, Allen would have to prove a number of elements he's claimed with witnesses testifying how they suffered health problems as a result of the smart meters and how the meters violate his constitutional rights.
In the meantime, GPA is moving ahead with the deployment of its Smart Meter program. Tonight they will speak to residents in Hagatna from 6:30-8pm at that village's community center.
