Effective Monday FMT out; powers restored to DMHSA

District Court Judge Consuelo Marshall has ordered that the duties and powers necessary to fully comply with the amended permanent injunction be returned to the Department of Mental Health and Substance Abuse's director, effective next Monday.

Guam - District Court Judge Consuelo Marshall has ordered that the duties and powers necessary to fully comply with the amended permanent injunction be returned to the Department of Mental Health and Substance Abuse's director, effective next Monday.  In an order the judge thanked the federal management team for its important and effective work noting that the team created and implemented a series of protocols and procedures designed to ensure future compliance with the API. 

Additionally, Marshall applauded the team's strides in hiring personnel, improving facilities and infrastructure, removing consumers off the wait list and planning the return of several consumers who are currently receiving treatment in Texas.  

DMHSA director Rey Vega has also been given authority over funds in a trust account that can only be used to further the goals of the court order.  Vega must also submit a written report every 90 days and continue to fill the 39 vacancies identified by the federal management team.
