Guam - Jimmy Chin Song was scheduled to appear in court today for a restitution hearing but the matter was continued. Song was convicted last year of manslaughter and aggravated assault for the death of Yun Mo Ku. He was sentenced to 12 years behind bars with five years suspended.

Song appealed the conviction to the Guam Supreme Court, but they denied his appeal finding there was enough evidence to prove the element of recklessness required for both charges. Defense Attorney Jeff Moots says the matter had to be continued because his client was not transported to the courthouse today and the defense has not received the restitution report.

The court has yet to schedule another hearing date.
