Guam - The defense is hoping Superior Court Judge Vern Perez will reconsider his decision not to dismiss all of the criminal charges against Charles Scharff, Ignacio Palacios, Joaquin Pangelinan, and Rose Evangelista.  The four were charged with theft by receiving, conspiracy, and criminal facilitation. 

They moved to dismiss the charges claiming the AG's Office took too long to prosecute and exceeded the statute of limitations to file the charges.  The judge dismissed the conspiracy and criminal facilitation charges with prejudice, which means they cannot be prosecuted on those charges again. The court found that the theft by receiving charge was within the statutory time frames for prosecution.

The defendants have filed a motion for reconsideration.
