CCU meeting this week
Guam Waterworks Authority management will be discussing whether it should go back to the superior court relative to disagreements over interpretations of public law with the PUC.
Guam - The Consolidated Commissions on Utilities is set to meet tomorrow where according to chairman Simon Sanchez, Guam Waterworks Authority management will be discussing whether it should go back to the superior court relative to disagreements over interpretations of public law with the PUC.
Sanchez says the PUC issued another order last month that would restrict the use of about $20 million from the 2010 bond GWA had issued. He says the GWA and PUC don't agree of how to pay that 20 million and how to reprogram the bonds. "Because really it's tying up $20 million and we think it's going to affect our ability to meet with the federal court order timelines and even though we pointed this out to the PUC, they still reserve this money," he said.
The Public Utilities Commission met last night where commissioners briefly discussed the recent order handed down by Superior Court Judge Michael Bordallo that found the PUC exceeded its statutory authority when ordering GWA to pay $18.3 million to the General Fund. The CCU will be sending a letter to PUC making it clear that they believe the PUC's interpretation of the law that tries to force GWA to pay $20 million from its current bonds is an error and would be in violation of its bond covenants.
