Guam - Defense attorneys in the attempted murder and aggravated assault case of Cameron Masnayon were granted another chance by the Superior Court of Guam to renew their motion to have their client's released from prison. William San Nicolas, and Daniel and Michael Rosal remain behind bars awaiting trial.

The Attorney General's Office filed a report detailing the current health condition of Masnayon, but defense attorneys like Jeff Warfield call the report inadequate. "I don't think it provides enough specificity to the court, it really uses very vague terms and does not address if the victim will be able to testify at trial and we've been going back and forth for three months trying to get an answer to that question," he said.

The report states Masnayon will find out at the end of the month if he qualifies to be an outpatient at a treatment facility in California, as he still has a hard time making conscious decisions. Assistant AG David Rivera said Masnayon will also need more angiogram and facial reconstructive surgery in Hawaii later this year. Rivera also defends concern that Masnayon left the treatment facility to go to Disneyland.

He said, "I was informed by the primary doctor that he was actually on a day therapy treatment trip which included a trip to Disneyland which was accompanied by a therapist as well as family and the purpose of that is to put into practice the various therapies he's been undergoing."

Since the prosecution could not provide an exact date when Masnayon will be able to return to Guam, the court granted the defense to renew their bail motions. A status hearing is set for September 14.
