Defense seeks mistrial in Isezaki case

Guam - A federal jury may have found Jeremiah Isezaki guilty following a jury trial, but there are questions about whether the 12 member jury actually agreed with the verdict. Isezaki was found guilty of being a felon in possession of a firearm. According to court documents, the jury was polled by the court after returning the guilty verdict.
Later the judge met with the jurors and expressed concern it wasn't clear that all twelve agreed with the verdict. The defense has moved for a motion of acquittal or a mistrial. The u.S. Attorney's Office meanwhile argues that any change of heart by jurors after the reading of the verdict, polling and discharge would simply be too late and any statements they made to impeach the verdict cannot be used.
The court issued an order today ordering that opposition to the motion for mistrial or a new trial must be filed by August 23 with replies due on August 30.
