Guam - Defense attorney Randy Cunliffe filed a motion to dismiss the child abuse allegations against his client, Jesse Aguero. Aguero was arrested in April along with Vanessa and Rhonda Aguero and Daryl, Michael and Alicia Santos. The six were charged after police found minors including an 8-month-old and a 3-year-old living in squalid conditions inside a make shift home in Mangilao on Dagu Lane.

But Cunliffe says there is no evidence to prove the abuse, telling KUAM News, "We filed a motion to dismiss all of the charges because we can't tell what it is he is accused of doing or the factual basis of which they are relying to say he committed a crime."

He adds attorney's representing the other defendants intend to join the motion. A hearing on the motion will be set at a later date.
