Guam - Michael Rosal Jr. and Daniel Rosal were denied their requests to be released from jail today.  They along with William San Nicolas are charged with attempted murder and aggravated assault for the March beating of Cameron Masnayon.

Superior Court Judge Arthur Barcinas found that the severity of the charges did not warrant Daniel's release on his personal recognizance and that the third-party requested for Michael did not have a sufficient relationship with the victim to be his custodian.

Despite objections from the defense, the judge granted the prosecution's motion to delay the trial indefinitely until Masnayon recovers from his injuries and can return to Guam to testify at the trial.  A status hearing will be held on June 20 when the government must provide an update on Masnayon's medical condition and when he is expected to return to the island.

The defense opposed the delay as two of the defendants have asserted their speedy trial rights. Meanwhile, the judge has taken a motion to sever, which would give the defendants separate trials, under advisement.
