Dismissal motion for Masnayon trial denied

Superior Court Judge Arthur Barcinas denied a defense motion to dismiss criminal charges against three men accused of brutally beating Cameron Masnayaon.

Guam - Superior Court Judge Arthur Barcinas denied a defense motion to dismiss criminal charges against three men accused of brutally beating Cameron Masnayaon.  During a hearing today, the defense sought for the dismissal of the charges against William San Nicolas and Daniel and Michael Rosal. The defense has also asked filed a motion to sever, which would mean the men would be tried separately.

Attorney Randy Cunliffe represents San Nicolas and told KUAM News, "I don't think they could prove a case against my client, and so if we got to go to trial then that's what we got to do. They don't have any evidence that they did anything wrong."

Whle the case is set for trial on May 30, assistant AG David Rivera believes there is good cause to extend the trial, as Masnayon, who is considered a key witness in the case, is still off-island going through rehabilitation. The court will hear the motion to sever on Wednesday as well as the Rosal brothers' bail motions.
