Guam - Three men who are being held behind bars charged with attempted murder have filed a motion to dismiss claiming they were the victims. William San Nicolas alleges that he had no involvement in the brutal beating of Cameron Masnayon, who was left unconscious in a Harmon parking lot back in March.
The defense contends the prosecution failed to present certain evidence to the grand jury that would negate San Nicolas' guilt.
According to the motion, the defense alleges that Masnayon called Michael Rosal, Jr. out to fight and approached his vehicle by bashing the windows with a baseball bat. Rosal claims that he was defending himself and that his brother, Daniel, assisted him.
San Nicolas claims he was approached by Christian Lastimoza who was carrying a bat and tried to fend him off. Court documents indicate that Michael Rosal turned over Masnayon's unconscious body and the three got into the car with two others and left the scene.
Daniel Rosal meanwhile is also seeking release from jail while Michael has asked to be released to a third-party custodian.
The court will hear motions on Monday while the trial is scheduled for May 30.
