Settlement could resolve pending OT lawsuit

Guam - A civil case that was settled last year for Department of Corrections officers could put an end to a separate lawsuit where officers are seeking ten percent interest on late overtime payments. During a recent hearing in warden Frank Crisostomo's case against the agency, Assistant Attorney General William Bischoff sought a 30-day continuance to review a decision and judgment that awards DepCor officers overtime compensation performed after 43 hours as well as hazardous and night differential pay.
The judgment also requires the department to pay out interest at the rate of 10 percent for any payments that are two weeks late or more. Bischoff says if the judgment applies, then the government would have no choice but to settle the pending case. For more than five years, the warden and other officers have been seeking more than $1.6 million in interest they say is owed to them for late OT payments.
Another hearing will be held next month.
