Judge explains dismissal of suit

Guam - Although she issued a decision back in December dismissing the Guam Preservation Trust, the National Trust for Historic Preservation, and We Are Guahan's lawsuit, Hawaii Judge Leslie Kobayashi issued a written order explaining why she threw out the case. Kobayashi found the issue was moot after the Navy agreed to conduct a supplemental environmental impact statement on the location of a firing range complex.

The judge, however, did not make any findings or conclusions on whether the original Record of Decision constituted a final agency action on the selection of the Route 15- Pagat area for the firing range complex.
